Welcome to Habiter! These Terms of Service (“Terms”) govern your access to and use of the Habiter mobile application, website, and associated services (collectively referred to as the “Platform”) provided by Habiter App (“Habiter”, “we”, “our”, or “us”).

By using our Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Platform.

1. About Habiter

Habiter is an AI-powered language learning platform that offers real-time voice-based and chat-based speaking practice, AI-generated feedback, fluency tracking, and personalized language improvement features. Peer-to-peer practice features may be introduced in future versions.

2. Eligibility & Account Creation

To use the Platform, you must:

  • Be at least 13 years of age, or have verified parental/legal guardian consent if you are under the age of majority in your jurisdiction.

  • Be capable of entering into a legally binding agreement under applicable laws.

  • Provide accurate and complete information at the time of registration and ensure it remains updated.

  • Maintain the confidentiality of your login credentials and accept responsibility for all activities under your account.

3. Services Provided

The Platform provides:

  • AI-driven real-time spoken English practice

  • Voice and chat-based interaction with AI tutors

  • Instant feedback and progress analysis

  • Gamification elements such as streaks, points, and fluency scores

We may add, modify, or remove features without notice.

4. Pricing, Payments, and Refunds

Some features of the Platform are available only under paid subscription plans. Payments are processed via Play Billing.

  • All purchases are final and non-refundable, except as required by applicable law or the policies of the billing platform.

  • Subscriptions are auto-renewed unless cancelled prior to the next billing cycle.

  • You are responsible for managing and cancelling your subscriptions.

5. User Conduct

You agree to:

  • Use the Platform solely for lawful, educational, and personal purposes.

  • Not copy, reverse-engineer, or misuse the Platform or its AI outputs.

  • Not upload harmful, abusive, misleading, or offensive content.

  • Not impersonate others or engage in harassment, fraud, or spamming.

We reserve the right to suspend or terminate accounts violating these rules.

6. Intellectual Property

All software, designs, algorithms, interfaces, text, graphics, logos, audio, and other elements of the Platform are the intellectual property of Habiter or its licensors.

You are granted a limited, non-exclusive, revocable, and non-transferable license to use the Platform solely for personal, non-commercial use.

7. User-Generated Content

You retain ownership of all voice inputs, chat messages, or other content you submit. However, by using the Platform, you grant Habiter a worldwide, royalty-free, sublicensable license to process, store, analyze, and use such content for:

  • Providing core services (like AI feedback)

  • Improving AI models and user experience

  • Internal training, debugging, and analytics

We do not use your content for external marketing or public display without your consent.

8. AI Interaction & Recording

The Platform uses AI tools to interpret, analyze, and respond to your spoken or written input. You consent to:

  • The real-time capture and processing of your voice or text by our AI systems

  • Temporary or session-based storage of data for processing and feedback

  • Review and analysis of your inputs for improvement and training purposes

We do not use your recordings or chats for public publishing.

9. Platform Availability

While we strive for uninterrupted access, we do not guarantee continuous uptime or a bug-free experience. Scheduled maintenance, server downtime, or feature modifications may occur without prior notice.

10. Data Protection & Privacy

We process your personal data in accordance with:

  • The Information Technology Act, 2000

  • The Digital Personal Data Protection Act, 2023 (India)

  • GDPR for users in the EU/EEA and UK

  • CCPA for residents of California

11. Third-Party Services

We may provide integrations or links to third-party tools or websites. We are not responsible for their terms, privacy practices, or service performance. Your use of such services is at your own discretion and risk.

12. Account Termination

We may suspend or permanently terminate your access to the Platform if:

  • You violate these Terms or applicable law

  • Your behavior poses a threat to other users or the Platform’s integrity

  • Required by court order, law enforcement, or government authority

13. Disclaimer

The Platform is provided on an “as-is” and “as-available” basis. While we aim to assist your language learning goals, we do not guarantee any specific educational outcome, fluency level, or skill improvement.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Habiter shall not be liable for:

  • Indirect, incidental, special, or consequential damages

  • Loss of data, profit, or business opportunity

  • Issues caused by third-party providers or device incompatibility

15. Indemnification

You agree to indemnify and hold harmless Habiter, its directors, employees, and affiliates against any third-party claims, damages, or legal costs arising out of:

  • Your misuse of the Platform

  • Your breach of these Terms or applicable laws

16. Export Control & Sanctions Compliance

You may not use the Platform if:

  • You are located in a country subject to Indian or U.S. government sanctions

  • You appear on the U.S. Department of Treasury’s Specially Designated Nationals (SDN) list

17. Governing Law & Jurisdiction

These Terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of the courts of Pune, Maharashtra.

18. Amendments

We reserve the right to update these Terms at any time. Significant changes will be notified through the Platform or by email. Continued usage after changes implies your acceptance of the revised Terms.
